Standard Terms and Conditions / Order Information
If you would like to order by mail or telephone, if you have any complaints or want to make use of your right of return, do not hesitate to contact us, preferably per email at info@sportmarkt1.de.info@sportmarkt1.de.
Prices & Forwarding Costs
All Prices are VAT included. A lump sum for delivery or COD costs will be added to the goods price depending on the mode of payment and country, if applicable. Forwarding costs and the resulting total are being calculated by the basket of goods system. You will see the amount to be paid before sending the order.
We deliver within Germany and into the other EU-countries; deliveries into Switzerland upon request.
Offer & Conclusion of Contract
The presentation of the products in the online shop represents no legally binding offer, but a non-binding online catalogue. All offers are valid while stocks last, unless otherwise stated with the products. Errors and omissions excepted. By clicking the button “Send Order” at the end of the ordering procedure you are placing a firm order of the items contained in the basket of goods. Immediately after sending, the receipt of your order will be confirmed together with the acceptance of the order by an automated email. By means of this email confirmation, the contract of sale is being concluded.
Sender
We are able to process your requirements only if you indicate your complete return address. Providing a telephone number is optional, but it may help to simplify the ordering process in case of queries. With COD orders, the indication of a telephone number is obligatory to facilitate delivery.
Delivery period
You shall receive the ordered goods as soon as possible. We dispatch them as a rule within 1 to 5 working days after receipt of order. Our parcel service delivers consignments of goods as a rule within another one to three working days. However, experience shows that there might be delays in the consignment of goods.

In case any item is out of stock, we shall inform you immediately and settle the further approach (replacement or cancellation) with you.
Terms of payment
The payment of goods shall be made by cash in advance, COD, credit card, or on account (the latter only for societies/enterprises/associations). You may also pay cash on collection; please contact us in this case separately before or immediately after ordering. COD delivery via DPD (norm) entails no delivery charges by the local deliverer; if you demand a COD delivery via DHL, please contact us immediately after ordering and note that the local deliverer charges currently a fee of 2.- euros. In case of credit card payment, we collect the invoice amount when delivering the goods. Please send neither money nor checks or stamps. We assume no liability in case of loss.
Protection of personal data
We will use your inventory data exclusively for the processing of your order. All client data shall be saved and processed according to the applicable regulations of the Federal Data Protection Act (Bundesdatenschutzgesetz - BDSG) and the Information and Communication Service Act (Teledienstdatenschutzgesetz - TDDSG). You are at any time entitled to free information, correction, blocking and deletion of your saved data. Please write to info@sportmarkt1.de or inform us of your request by mail or fax.
The transfer of your personal data including your home and email address to third parties without your express and revocable consent shall be excluded, with the exception of our service partners, who require the transfer of data for the purpose of order processing (e.g. the mail-order business in charge of delivery and/or financial institution in charge of payment processing). In these cases, however, the extent of the transferred data is limited to the required minimum.
Your personal data will be transferred after encoding by means of 128 bit SSL v3, RC4, RSA with 1024 bit exchange. We apply technical and organizational security measures to protect your data against incidental or intentional manipulation, loss, destruction, or against access by unauthorized persons.
Cookies
Persistent cookies, which are being saved to your hard disk, will not be used for the shop system. Within the scope of partner programs, a persistent cookie that contains no personal data or similar information may possibly be saved for the purpose of assigning any commission claims to third parties. Thus, no user-related data will be read on or written to your hard disk when ordering.
We use a so-called session-id, which, for a certain period of time, can be stored in a session cookie or is shown in the address line of your browser. That means that the information concerning the basket of goods content, i.e. what you have ordered, and the time limits, i.e. how long you are surfing our website, will be managed only within the server memory of our provider during the time of your visit. After you have ordered or surfed on to another site, all data saved for a short time will be automatically deleted, after 30 days at the latest. Your personal data will not be saved for purposes going beyond processing the order and will used only for processing the ordering procedure, unless you did not give your express consent when entering the data.

Revocation right
You may revoke your contract statement without statement of reason within two weeks by sending a text (e.g. letter, fax, email) or returning the thing. The period does not start before receipt of this instruction. For maintaining the revocation period, it is sufficient to send the revocation or the thing in time. Consequences of Revocation
In case of an effective revocation, both parties shall restore what they have received in performance of the contract (and shall return any derived fruits of a thing or usufruct of a right, e. g. interest). If you are not able to restore what you have received in whole or in part or in an impeccable condition, you shall compensate us for any lost value. This does not apply for the leaving of things if the deterioration of the thing is to be attributed exclusively to its examination, which could have been effected by you in the store. Apart from that, you can avoid the obligation of compensating for lost value by not making use of the thing as your property and by forbearing everything that affects its value. Things that can be dispatched as package are to be returned. You have to bear the returning costs if the delivered goods correspond to the ones ordered, and if the price of the thing to be returned does not exceed an amount of 40 euros, or if you, in case of a higher price, have not executed yet the consideration or a part payment as agreed by contract at the time of revocation. Otherwise the return is free for you. Things that cannot be dispatched as package will be collected at your place. You shall fulfil any obligations regarding the execution of payments within 30 days after you have sent your declaration of revocation.

Warranty
Warranty is subject to the legal provisions, it being understood that, in case of defective goods, we will at first effect subsequent delivery or improvement, according to your choice. If the subsequent improvement fails or the subsequently delivered goods are also defective, you may return the goods and will receive back the full purchase price, or you may keep the goods and reduce the purchase price. For information on any manufacturer warranties, please refer to the documentation of the product.

Severability
The nullity of any of the provisions herein or within the scope of other agreements shall not affect the validity of all other provisions or agreements.
